Prediction: Supreme court upholds conviction 5-4 or 6-3. The report about the gun gave them probable cause to enter and search the house. The men having sex were under plain view.

Privacy wasn't violated (Are we going to require separate warrants for the bedroom?)

Plain view has been standard for years.

The court will sidestep the constitutional rights issue and argue that regulations on this particular issue devolve to state legislatures by going narrow rather than broad--you can criminalize sodomy, but it's gotta be for everyone.

Thoughts?

Texas needs to start worrying about their crappy economy, horrible education system and (post Dubya)the fact that they are now one of the most polluted states in the country. Sex acts between adults should not be the business of any government or over sight body but of course the Republican's ( the party of individual rights, hahaha) will have to suck up to their redneck, jezus freak southern constituants and oppress any one who doesn't confrom to their stadards.

The extreme right wing Supreme Court will, of course, rule in favor of the State.

It goes to show you that some distraction and/or scapegoat is needed to justify some sort of upholding the moral code.
When will the US start applying its laws to everyone?
