Prediction: Supreme court upholds conviction 5-4 or 6-3. The report about the gun gave them probable cause to enter and search the house. The men having sex were under plain view.
Privacy wasn't violated (Are we going to require separate warrants for the bedroom?)
Plain view has been standard for years.
The court will sidestep the constitutional rights issue and argue that regulations on this particular issue devolve to state legislatures by going narrow rather than broad--you can criminalize sodomy, but it's gotta be for everyone.
