A San Francisco man is facing prison after being found guilty Wednesday of punching an African American man because of his race and the fact he was enjoying himself at a Chico bar.

A jury of six women and six men deliberated 2½ hours at the conclusion of a three-day trial in Sacramento federal court before finding Eric Loren Clawson guilty of a hate-based violation of Carl Whitfield's civil rights.

Clawson, 28, was taken into custody following the verdict. He was handcuffed and escorted out of the courtroom by deputy U.S. marshals as distraught family members, including his parents and sister, looked on.

Once an amateur mixed martial arts champion in the light heavyweight division, Clawson knocked the 6-foot-4, 240-pound Whitfield down and out with one punch. Witnesses said he was out for 20 to 30 seconds, and in a daze for a while.

Clawson testified he approached a group that included Whitfield and inquired why they were looking across the room at him and "seemed disturbed." When he asked, "What's the problem?" Whitfield stood up and faced Clawson, looking angry and "ready to fight," so Clawson went on the offensive, he said.

The element of surprise is a bar fighter's best friend, and Clawson testified he's been in dozens of them.

He acknowledged that earlier, in ordering and paying for drinks, he made two remarks to the bartender that included a racial epithet generally applied to African Americans.

But, Clawson testified, he was not describing Whitfield but meant it as a euphemism for "cheap." He said he saw Whitfield only later when he and others around him began staring and acting as if they were unhappy with Clawson.

Whitfield, his girlfriend and bartender James Kellon Thompson testified that as Clawson and friend Joe Grivette entered Riley's Bar & Grill on the night of July 6, 2008, somebody said, "I'm not sitting here with that n-----," and it came from their direction.

The three prosecution witnesses said Clawson, without provocation, wordlessly walked up behind Whitfield, tapped him on the shoulder and, when Whitfield turned, hit him.

Clawson denied using the epithet in reference to Whitfield, insisting he didn't even see Whitfield when he came into Riley's that Sunday night.

"That's nonsense," Assistant U.S. Attorney Russell Carlberg told the jury in a rebuttal argument.

"He saw Carl Whitfield. Everybody knows it. He picked him out and attacked him."

Defense lawyer Emily Doringer told the jury in her closing argument that, while her client is a brawler, he bears no racial animus and only one other of his many altercations involved an African American man.

"He has no problems interacting, socializing and otherwise dealing with African Americans," she said. "There's just no history here."

She noted that Whitfield and girlfriend Noelle Keese testified they heard a racially derogatory comment when Clawson and Grivette came in, but did not tell that to Chico police officers who took their statements shortly after the incident.

"That means there is doubt," Doringer argued.

She also said that, if Clawson were going to direct an epithet at Whitfield, he would have done it when he approached him, but he said nothing.

"That is serious doubt about what was going through Mr. Clawson's mind," she told the jury.

"He let his fist do the talking," was Carlberg's rejoinder.

Clawson and Grivette were both charged with the hate crime.

Grivette, 29, pleaded guilty to a lesser charge a week ago and validated the prosecution's version of the incident.

Grivette was outside when Clawson felled Whitfield. But minutes before the punch, as he left Riley's, he assured his friend, "Whatever you do, I've got your back."

Under the terms of a plea bargain, Grivette's lawyer is free to argue for as little as two months behind bars.

Clawson's sentencing is set for June 10. His crime carries a maximum 10 years in prison.

Martial arts director charged with sexual assault of student

    By Curtis Lum
    Advertiser Staff Writer

The founder of a Hawai'i martial arts school was charged Wednesday night in connection with the alleged sexual assault of one of his teenage students.

Michael Shimabukuro, 31, of Moanalua was arrested at 4 p.m. Wednesday at the main police station on South Beretania Street. He was charged with one count of first-degree sexual assault and two counts of third-degree sexual assault.

Shimabukuro was released on $250,000 bail at about 7 p.m., police said. He could not be reached for comment Wednesday night.

Police said a 17-year-old girl reported being sexually assaulted from May 2008 to July 2008.

The girl told police the assaults occurred at the Japanese Cultural Center in Mo'ili'ili, where she took karate classes.

The girl said her assailant was her karate instructor. An investigation led police to Shimabukuro, who turned himself in yesterday at the police station.

Shimabukuro founded the Hawaii Karate Association in 2002. He is a fourth-degree black belt and a certified karate instructor, according to the HKA Web site.

He was a USA National Karate-do Federation national champion in 1995 and 1996 and a Junior Olympic champion in 1996, according to the Web site.

    A 60,000+ person con?

Were any members here associated with the AMA?
    Martial arts conman is jailed
    10:47am Wednesday 7th April 2010

A BLACK belt martial arts instructor has been jailed for three years for a nearly £200,000 con involving 60,000 people.

Paul Griffin, of Princes Avenue, Corringham, is a 7th level Dan black belt and ran the British National Martial Arts Association from his home.

But Griffin, who has trained several martial arts champions and been involved in television shows about the sport, was the brains behind a four-year long con.

He began organising insurance for members of the Derby-based Amateur Martial Association (AMA) in 2001.

The insurance is required by law for people taking part in the sport.

But between 2001 and 2004, instead of arranging full insurance cover for the AMA’s more than 60,000 members, he pocketed the cash.

Griffin pocketed £182,386 in fees and his scam meant thousands of people taking part in the sport would not have been insured if they caused or suffered serious injury.

Derby Crown Court heard the AMA became suspicious of Griffin after members made several queries about their insurance policies.

The AMA also made several unsuccessful attempts to contact him.

They called in police and Griffin’s con was uncovered.

After a complex four-year investigation, Griffin finally pleaded guilty to theft and was jailed for three years.

Investigating officer Sgt Matt Carson, of Derbyshire police, welcomed the sentence.

He said: “This was a long and laborious case so it is satisfying the people involved have some sense of justice.

“One of the biggest challenges was going through all the data we received – this was a mammoth task.

“The most worrying thing about the case was that of the 63,369 members put through by the AMA to Griffin, 60,281 were not insured or insured correctly, which meant they had no cover at all.”

Judge Robert Brown said Griffin’s actions had put thousands of martial arts students and instructors at “serious risk” of injury for which they would not be covered.

Last week, a former UFC fighter who legally changed his name to War Machine was arrested in San Diego after running amok in a bar. Among other things, he had struck one patron in the head, sending him to a hospital. Police had to place a plastic bag over his head to prevent him from spitting at them.

One who doesn't trust is likely not to be trusted.

What you are saying is what you have seen in the media.

some catholic priests have been deemed pedophiles.
some episcopalian priests too! and dentists, doctors, mechanics, bakers, welfare recipients, family members etc etc.

It is sensational when a person in a position of trust breaks that trust and that is why you read about it in the media or see it in the media etc.

There are thousands of Catholic priests who are good decent and upright. Same with any church, temple, mosque etc. The majority are morally upright and ethical. But where better for evil to hide than in the folds of the good?

yes, be careful, but don't blackball entire institutions based on a news story here and there.

    Segal and Sex Slaves

So much for upholding the law on Lawman, or being a reincarnated Lama.

    http://www.msnbc.msn.com/id/36446224...t-celebrities/

Steven Seagal is accused of hiring young women as personal attendants whose real job was to serve his strange and sometimes violent sexual desires, according to a civil lawsuit filed Monday in Los Angeles by a 23-year-old former model who describes her experience in harrowing detail.

The plaintiff, Kayden Nguyen, said she met the action star in February through an ad on Craigslist seeking an executive assistant and, after three interviews, was told to pack for a trip to New Orleans, where the A&E show "Steven Seagal Lawman" was taping.

When she arrived, the lawsuit says, she discovered that Seagal had been keeping two young female Russian "attendants" who were essentially on-call for sex — 24-seven.

On that first night, Nguyen was ushered to a secluded house where Seagal was staying with his wife and the two young women. He then proceeded to treat Nguyen as his "sex toy" despite her complaints, the lawsuit says.

She complained the following morning to some of the other employees, assuming that they would deliver the message to Seagal. Hours later, the lawsuit says he assaulted her again, this time forcing her to consume "illegal pills."

The following morning, when she confronted Seagal herself, he told her there had been a "misunderstanding"; but hours later, he assaulted her a third time, an attack that stopped only when she ran away, according to the lawsuit.

The ordeal carried on for several days, and it wasn't until Feb. 28 — the following Sunday — that she was able to escape the situation, the lawsuit says.

The lawsuit says Nguyen told Seagal that she had to leave to meet with family members who would be suspicious if she didn't show up. Nonetheless, he told her not to leave the house and followed her with a gun equipped with a flashlight as she went out to a waiting cab, which sped away as she jumped in the front seat.

A message left by TheWrap with the action star's attorney, Stuart Rosenthal, was not immediately returned Monday. Messages left with A&E were also not immediately returned.

It was not clear why Kayden Nguyen chose to file a civil lawsuit instead of a criminal complaint. Messages left with her lawyers were not immediately returned Monday.

Nguyen's lawsuit claims that even after she got away, Seagal and his employees tried desperately to persuade her to return. When she escaped, she left behind "everything of value she owned," including car keys, her laptop, clothes, and "hundreds of dollars worth of makeup." She was told she would not get the items back until she signed an agreement stating she would not report the sexual attacks.

The lawsuit says Nguyen had accepted the job on Feb. 22, a Monday, and was sped in a limo to a waiting private jet. Her first indication that something was awry was when Seagal told her, as the plane was taking off, that his wife "wouldn't mind if we had a sexual relationship."

Nguyen's lawsuit said she could identify a "unique physiological reaction" that Seagal has to sexual arousal, which could be corroborated by the other "attendants." The suit did not specify what that reaction is.

The lawsuit alleges sexual harassment in violation of federal labor laws; illegal sex trafficking; retaliation; wrongful termination; and false representations about employment. Each of the six counts seeks in excess of $1 million in damages.

Kayden Nguyen sues action star Steven Seagal for sexual assault, employing her as his 'sex toy'

A former employee has sued big screen action star Steven Seagal, claiming he hired her as an assistant, but then used her as a "sex toy."

Kayden Nguyen, a 23-year-old former model from Los Angeles, is seeking $1 million from the "Under Siege" actor, according to court papers filed Monday.

Nguyen said she responded to a Craigslist ad in February for an executive assistant for Seagal and his production company, Steamroller Productions.

When she arrived in New Orleans, where Seagal films his reality show, "Steven Seagal Lawman," Nguyen said she quickly realized she had been hired to replace one of two "attendants" who were "available for his sexual needs 24 hours a day, 7 days a week."

Seagal, 58, asked Nguyen and another woman on his staff for a massage, court papers say.

When she refused, he forced his hand down her pants and told her to "relax, we won't do anything special tonight. I'll save that for another night," according to the lawsuit.

Nguyen said she tried to flee the house, but Seagal and his staff wouldn't let her.

"I was terrified of Seagal," she said. "I feared for my safety."

Nguyen said she left her keys and laptop behind and hopped a flight back to L.A. She said Seagal told her he was "a family man" but that his wife "wouldn't care if you were my lover."

Seagal's attorney, Marty Singer, called the lawsuit "a ridiculous and absurd claim by a disgruntled ex-employee who was fired."

If anyone doesn't think Segal is anything more than a deluded hollywood type spoiled rotten by isolation from reality.

    Check again.

watch his show. the guy is a meltdown on a trainwreck from space. lol

I think his new show is more of a joke than anything.

Chubby excited actor who used to do aikido running after minor perps in reality tv show. A fitting demise to an otherwise mediocre career really.

Valero kills self in jail cell.
    Boxer who killed his wife.

    http://www.cbc.ca/sports/story/2010/...o-suicide.html

Former boxing champion Edwin Valero has committed suicide in his jail cell just hours after he was arrested in Venezuela in connection with his wife's killing, police said.

The former lightweight champ used his own clothes to hang himself in his cell early Monday, officials said.

Venezuelan Federal Police Chief Wilmer Flores said Valero had tied his clothes to a cell bar.

Flores said another inmate alerted authorities in the police lockup in north-central Carabobo state. Valero still showed signs of life, but they were unable to save him.

The 28-year-old was detained Sunday on suspicion of killing his wife, Jennifer Viera, the gravest in a string of problems that had threatened to derail his career.

Prosecutors said Sunday night they planned to charge Valero after they found the body of his 24-year-old wife in a hotel in Valencia. The boxer left the hotel room around dawn Sunday and allegedly told security he had killed Viera, Flores said.

The fighter was a household name in Venezuela and had a huge image of President Hugo Chavez tattooed on his chest, along with the country's yellow, blue and red flag.
    Popular fighter

His all-action style and 27-0 record — all by knockouts —earned him a reputation as a tough, explosive crowd-pleaser.

Venezuelans called him "Inca," while elsewhere he was called "Dinamita," or dynamite.

The former WBA super-featherweight and WBC lightweight champion had been in trouble with the law before.

Last month, Valero was charged with harassing his wife and threatening medical personnel who treated her at a hospital in the western city of Merida. Police arrested him after an argument with a doctor and nurse at the hospital, where his wife was being treated for a series of injuries, including a punctured lung and broken ribs.

The Attorney General's Office said Valero was detained March 25 on suspicion of assaulting his wife, but his wife told a police officer her injuries resulted from a fall.

When the boxer arrived moments later, he ordered Viera not to speak to the police officer, and he spoke threateningly to the officer, prosecutors said in a statement.

The Attorney General's Office said a prosecutor had asked a court to order Valero jailed but the judge instead placed him under a restraining order that barred him from going near his wife, a condition he repeatedly violated.

tension vs relaxation (state of mind)

it is much more complicated than that, but

    1. growing up in a military/police families and relatives, I know that it is important to learn to relax or unwind. if we remain tense all the time, sooner or later we will snap.

    2. but for the most part, it is a fatigue for most of us.

like fireman or jet fighter pilots in ready room. the alarm signals, you are ready to go---

if you put your mind in that state, only for a while, we may be alright. but if you do that all the time, we will all snap.

    ---

    3. in the ring, you let the animal/beast in you to come out for a while, off the ring, we have to do the opposite to tame our self or soften ourself--

music, dance, song, swimming, --- let our body and mind do something else.

    4. fighting is important, but it is not all of your life. learning to be at peace with ourself and others are also part of the picture/life.--

oom yung do - at it again

    http://www.cbs8.com/Global/story.asp?S=12338432

SAN DIEGO, Calif. (CBS 8) - A local martial arts group is being accused of using intimidation and coercion to rip off students. One local student has filed a lawsuit, alleging she lost thousands of dollars to the organization.

It's called Oom Yung Doe, a martial arts school on Balboa Avenue in Clairemont. The school is covered with photographs of its spiritual leader, John C. Kim. One former student is now suing the school's associates and instructors.

"I thought they were people with integrity. They claim to be, that's how they present themselves," Vivien Francis said.

Francis believes she was intimidated and even brainwashed into giving the Oom Yung Doe organization $47,000.

"They promised me they were going to revise the ownership of the school and make me part owner of the school," she said.

In her lawsuit, Francis accuses Oom Yung Doe of being a cult-like organization run with an iron fist by the school's grandmaster John C. Kim. What most people don't know is that the school's grandmaster is also an ex-con.

Back in the mid-90s, John C. Kim and several other defendants were found guilty in Chicago of conspiracy to commit tax fraud. Kim was accused of skimming millions of dollars in profits from his national network of martial arts schools.

Attorney Evelyn Deaton filed the lawsuit in San Diego court against Kim, Thomas White and Robert Sawinski.

Court records show all three served prison time from that earlier case in Chicago. The three defendants now live in San Diego.

Also named in the suit is a company in Rose Canyon called Jadience. The firm sells herbal creams, lotions and spa treatments over the internet. Deaton believes the defendants are all involved in the Oom Yung Doe martial arts organization.

"I believe it's a cult because they use intimidation and abuse of power to get money from individuals and to control them," Deaton said.

In her lawsuit, Francis says the school's leaders tried to control who she dated, and she alleges sexual harassment by one of the instructors.

"I felt very uncomfortable. I felt he was harassing me. He is an older man. I had no interest in him," Francis said.

All three defendants in the lawsuit declined to speak with News 8. We found no one home at Thomas White's house in University City, and even though there were vehicles in the driveway, nobody answered the door at John Kim's home in La Jolla.

In a written statement to News 8, John Kim's attorney said the lawsuit has no merit. The statement goes on to say, "(Mr. Kim) met Ms. Francis on only two or three brief occasions in group gatherings. Mr. Kim believes that he will be vindicated in a court of justice once all the evidence and facts are revealed."
