    Mario Perez was shot and killed after threatening to kill a man, his wife, and his children.

    After reviewing the evidence, a grand jury in Maryland has declined to press charges against a businessman who shot and killed a drunken man who threatened to kill his family during a holiday party.

    A grand jury declined to indict Francisco A. Trujillo in the killing of Mario Alberto Perez, the Montgomery County State’s Attorney’s Office announced Friday afternoon.

    Trujillo, 35, said he shot and killed Perez, 40, early the morning of Dec. 21 after Perez threatened Trujillo inside his own home in Damascus, Maryland.

    “It was a surreal, tragic experience,” Trujillo told News4 on Friday.

    The construction executive was hosting a small holiday gathering on the 24600 block of Ridge Road just days before Christmas when his acquaintance drunkenly started an argument with him, he said. Perez threatened to kill Trujillo, his wife and his children, who are 8 and 4 years old and were home at the time.

    This case is the textbook justification for an armed citizen to shoot an unarmed man.

    Perez was a much larger man than Trujillo and a known “martial arts expert” (precisely which martial art he practiced was not mentioned in the article).

    Perez was also in Trujillo’s home, threatening Trujillo’s wife and two small children. Even in those localities where there is a duty to retreat, he did not have the practical option of retreat.

    When Perez would not back down, Trujillo had little choice other than to fire in his own self-defense before Perez could get into range to disarm Trujillo. When Perez ceased to be a threat—after one well-aimed shot—Trujillo did not fire his weapon again.

    I’m not surprised in the least that Trujillo was arrested by police, or that a district attorney in an anti-gun state such as Maryland would attempt to charge Trujillo with murder in what seems to be a relatively cut-and-dried case of self-defense. These people simply don’t think correctly.

    What is somewhat amazing is that the grand jury looked at the evidence and declined to prosecute. Grand juries typically only see a one-sided case, heavily biased by the prosecutor. They do not get both sides of the story. That comes later in the criminal trial.

    That Trujillo wasn’t indicted suggests that there was no ambiguity at all in this incident.

    By the way, the next time you hear someone saying that only cops can get away with shooting an unarmed suspect, feel free to cite this case.

    It has always been about the disparity of force, which is far more complex than just “armed” or “unarmed.”

    Former Martial Arts Instructor Sentenced to More Time in Prison

    A former martial arts instructor from Augusta has been sentenced to 60 years in prison for raping two young boys and videotaping it.

    That sentence will be served concurrently with a federal sentence for child pornography charges.

    “There is no trust more sacred than the one the world holds with its children. That’s what we’re here for today your honor,” said Kennebec County Deputy District Attorney Paul Cavanaugh.

    Invoking the words of former UN Secretary General Kofi Annan, prosecutors asked for a long sentence for 38-year-old Wade Hoover.

    The former martial arts instructor pled guilty in November to sexually assaulting two boys under 12 between 2008 and 2010.

    The state asked the judge to consider additional video evidence they say shows Hoover drugged his victims–one in Kennebec, the other in Somerset County.

    “Mr. Hoover needs to be punished for this conduct. It is reprehensible, it is heinous, it is vile,” said Cavanaugh.

    A mother of one of the victims took the stand, asking for the maximum sentence…we’ve taken steps to protect her identity.

    “A man who has committed these types of crimes with such intensity and severity should never be allowed on the streets again. How many more children do we really not know about that he has harmed,” said the mother.

    Hoover is already serving a 40-year sentence for federal child pornography charges.

    “It deserves a significant sentence but this isn’t a murder case,” said Hoover’s attorney Scott Hess.

    Hoover himself spoke as well, addressing each victim.

    “I am sorry for what I have done, and hope you can forgive. Hopefully your mother can move forward as you. We all need to move forward, because forward is where we may find peace. Thank you for listening,” said Hoover.

    Prosecutors say they’re skeptical of Hoover’s show of remorse this time around.

    “It seemed a little more rehearsed to me, like the first one didn’t get him what he wanted, so he came up with a different one to see if he got a better result,” said Cavanaugh.

    Cavanaugh says he hopes a 60-year sentence sends a message to would-be abusers.

    “We seem to be seeing a lot more child pornography and we seem to be seeing a lot more sort of hands on child abuse. I hope people understand that conduct is going to get severe life sentences. We will do everything we can to keep the children safe,” said Cavanaugh.

    Hoover is set to remain in federal custody until at least 2047.

    At that point he will be transferred to state custody for the remainder of the state sentence.

    A 26-year-old Queens man has been charged with sexually abusing four female students while he worked as a Tae Kwon Do instructor, prosecutors said.

    Lorenzo Ramos of Elmhurst, Queens, was arraigned earlier this month on criminal charges involving one of the girls. He was later arraigned on March 11 on a criminal complaint involving the other three girls. Ramos is charged with sexual abuse, attempted sexual abuse, forcible touching, endangering the welfare of a child and harassment.

    “These are serious allegations. As a martial arts instructor the defendant was supposed to train his students to protect themselves from unwanted advances. Instead he is accused of taking advantage of his teaching position to touch his students in inappropriate ways,” Queens District Attorney Richard A. Brown said in a statement announcing the charges Monday.

    Ramos is accused of sexually abusing and forcibly touching two 12-year-old girls and two 14-year-old girls at various times over the last 19 months.

    According to the district attorney’s office, “Ramos, while working as an instructor at United Tae Kwon Doe, located at 97-12 Roosevelt Ave., and on multiple occasions between May 1, 2015, and Feb. 25, 2016, approached his four female victims individually and touched them in an inappropriate manner —such as hugging them, picking them up, grabbing their breasts and squeezing their buttocks.” He also allegedly rubbed himself inappropriately against one of the victims.

    He additionally is accused of giving or offering money to three of the girls, telling one of them, “Don’t say anything because both of us will be killed.”

    Ramos was allegedly caught when the "victims voiced concern among themselves and the owners of the martial studio spoke with them,” prosecutors explained. After Ramos was let go from the studio, one of the victims told her mother what had happened, and she contacted the police.

    District Attorney Brown asks anyone who believes that they may have been a victim of this same abuse to contact the NYPD’s Queens Special Victim Squad at 718-520-9277.

    Ramos, who faces up to seven years in prison if convicted, was ordered held on a $31,000 bail and to return to court on April 1.

    SEATTLE – A 21-year-old University of Washington student was charged with first-degree murder on Wednesday after prosecutors said he beat and strangled his girlfriend during a bad acid trip.

    Casey Henderson is accused of killing Katy Straalsund, 22, Sunday afternoon at her apartment on NE 50th in Seattle. Police say he told them he grew paranoid after they’d spent the night and morning high on LSD they’d purchased on the street Saturday evening.

    Charging documents show Henderson told police things “started to get weird” and that he began to believe she was “plotting against him.” They say he admitted to punching her in the face and head, and to kicking her using techniques he’d used in taekwondo.

    Henderson allegedly told police he strangled her with both hands while yelling “do you want to live?” He told detectives she “kept saying stop, what are you doing.” Police said when they sent him to the hospital because his hand was “extremely swollen and red,” and learned he’d fractured his wrist.

    Henderson told police he and Straalsund had been dating for about six months.

    Police said they were called in at about 2 p.m. on Sunday by a neighbor who heard a man yelling “you wanna die” and “I will kill you.”

    Once they got there, one of the officers reported seeing Henderson strangling Straalsund. The officer said both were naked, and that by the time they got inside he was holding her in a chokehold from behind.

    Police broke it up and attempted CPR.

    Straalsund died later at the hospital.

    Charging documents also show that police talked to Straalsund’s cousin. The cousin told them that Straalsund had recently confided that she’d learned Henderson was dating another woman, with whom he planned to move to Paris.

    The cousin said Straalsund didn’t consider her own relationship with Henderson serious.

    Lawyer probed in ‘Kung Fu Judge’ missing $700K inheritance

    A Queens lawyer accused of looting the estate of a Brooklyn judge is being probed by a grand jury over seven counts of grand larceny that accuse him of pocketing more than $700,000 in inheritance, The Post has learned.

    Attorney Frank Racano — currently serving a 30 day contempt-of-court sentence for not accounting for funds taken from the estate of the late Judge John Phillips — admitted to a Brooklyn surrogate’s court judge in March that he’d written checks to himself from the deceased jurist’s escrow account.

    Phillips was known as the “Kung Fu Judge” because of his black belt and habit of breaking out martial arts moves during court proceedings.

    The Brooklyn DA’s office is “moving forward with an indictment on the criminal charges,” Phillips’ nephew, the Rev. Samuel Boykin, said Wednesday.

    “My family and I are alleging that he has ripped the estate off for 713,000,” Boykin said of Racano, who he had hired to help handle the estate.

    A law enforcement source confirmed Racano was “under investigation.”

    The disgruntled nephew also recently filed a $160 million notice of claim against the city, saying he was improperly removed as executor of Phillips’ estate in January 2015 and “illegally” replaced with public administrator Charles Fiori.

    Fiori then went on to settle the family’s $40M wrongful death suit against Prospect Park Residence — where the judge froze to death in 2008 — for just $750G, without consulting any of them, Boykin said.

    “None of the seven heirs have any idea what happened to the $750,000. We have no idea where it is,” Boykin told The Post. “Many of my family members believe he stole the money. Fiori has been over the estate since January 2015, and not only do we not know where the money is, but we have no idea what he’s doing with it.

    “These people have taken that money, pretended it was theirs, and disappeared,” a frustrated Boykin continued, referring to both Racano and Fiori.

    “All seven heirs are highly upset, and wondering how the courts could let these people get away with this,” he added. “My uncle served as a civil court judge for 17 years, and the system he served so diligently has really let him down.”

    Boykin says he also intends to sue Queens DA Richard Brown, because he filed a complaint with his office asking them to investigate Racano’s actions in February 2016, and they never responded.

    It wasn’t until Boykin reached out to Brooklyn DA Ken Thompson following Racano’s admission of theft in court that the claims were taken seriously, he said.

    Customer sues Costco, claims employee used martial arts to break leg

    In a lawsuit filed in Multnomah Circuit Court, a Costco customer accused employees of holding him against his will and breaking his leg after he was asked to show his receipt.
    PORTLAND, Ore. - Court documents filed in Multnomah County Circuit court claim Costco employees asked customer Timothy Walls for his receipt as he left the Costco on NE Sandy Blvd. Employees say Walls refused to show him their receipt, violating Costco policy.

    The lawsuit alleges employees made Walls feel as though he was "held against his will" (click here, to read entire comlpaint). The timeline of events details in the lawsuit include Walls response. The lawsuit states, Mr Walls grabbed the first Costco employee by the shirt collar, "pulling him away from the shopping cart holding his personal property."

    Walls claims a second employee then intervened and, "...employed a martial arts type strike with his leg... fractured Mr. Walls' tibia."

    A police report filed that day, January 28, 2013, details accounts from store employees including a handwritten statement from the employee Walls accuses of attacking him and breaking his leg. The employee writes, the Walls had pressed the other employee against the wall and the custoemr had his hands around that employees' throat.

    The second employee goes on to write, "I stepped in, pulled member off--asked him to calm down. He put his hands on me and then I put him on the ground, to calm down. Then I left upon members' request."

    When KATU asked, Bill Stockton, the attorney representing Costco, "Does Costco believe its employees were right in everything they did?" Stockton replied, "Yes."

    Attorney Clayton Morrison represents represents Timothy Walls. Morrison told KATU, "Our goal is to have this issue resolved and to obtain compensation for Mr. Walls in regards to some pretty serious injuries he sustained."

    Morrison went on to say, "If you’re a customers and you decide to walk out without a showing a receipt what can the store do in that situation can the store detain you?" He added, " We would like to clearly establish under Oregon law that you have a right to walk out of the store without being detained."

    MACNHESTER, N.H. —A 42-year-old man who police say performed "kung fu-like moves" at a convenience store Wednesday night was arrested on drug charges and outstanding warrants, Manchester police said.

    Manchester police Officer Richard Valenti responded at 11:24 p.m. Wednesday to TN Convenience at 90 Bridge St. on a report of a disorderly person.

    Valenti said he found a man flailing his arms while kicking his legs in the air.

    Tige Dyer, 42, of Manchester, was wanted on several warrants involving stolen property and theft and was taken into custody. Police said they searched Dyer and found approximately 9 grams of heroin and .55 grams of crack cocaine in his possession.

    Dyer was taken to police headquarters and placed on a 72-hour hold for a parole violation. He was charged with two counts of possession of a controlled drug and was scheduled to appear in court on Thursday.

    Former Firefighter Convicted Of Fraudulently Collecting Disability, Found To Be Doing Martial Arts

    TRENTON, Nj., (CBS) — New Jersey’s acting Attorney General, Robert Lougy, announced that Shane B. Streater, a former Camden Firefighter, was convicted of stealing more than $82,000 by fraudulently collecting a disability pension from the state’s Police and Firemen’s Retirement System. While doing so, Streater was working as a martial arts instructor and participating in competitive mixed martial arts.

    Streater, 41, was convicted of second-degree theft by deception. Sentencing is scheduled for May 20.

    “Streater portrayed himself as a firefighter permanently disabled in the line of duty, but it was all a shameful charade, as he demonstrated by engaging in strenuous martial arts activities,” said Lougy. “His ploy to steal pension benefits was a slap in the face of the honest firefighters and officers who continue to serve the public bravely and who are counting on that pension fund for their retirement.”

    Streater applied for accidental disability pension in January, 2010, claiming that he was disabled as a result of two accidents while on duty.

    Doctors concluded that his disability was caused by a pre-existing condition and therefore, he qualified for ordinary disability pension, which pays out 40 percent of a person’s salary and is taxed. Streated appealed for accidental disability pension which is not taxed and pays two-thirds of the person’s salary.

    Investigators unearthed video or Streater taking part in martial arts as he was collecting pension, which was as a result, revoked in April, 2012. By that time, Streater had collected $82,488 in benefits.

    “I didn’t take advantage of the system in anyway,” Streater told Eyewitness News.

    “Today I can feel fine. Tomorrow I can wake up and barely be able to climb up the steps,” Streater said.

    Given the cursory nature of this news report, it's impossible to really say what happened. Perhaps Guo did use excessive force. But still, it all feels so wrong. It sounds like he tried to do the right thing and is getting severely punished for it.

    Guo Gang is a 17-year-old student who saved a woman from harassment on the bus. However, his righteous behavior not only went unrewarded, he was actually punished for it. Recently his story was posted on Weibo, and many netizens are forwarding and reposting it, hoping to locate the female victim to testify for him.
    On March 23, 2015, Guo and his friends took a bus from Dujiangyan to Luzhou in Sichuan province. On the bus they saw a man around 30 years old pawing at a girl who was clearly uncomfortable with his advances. When they arrived at Luzhou, the man even held the girl to stop her from leaving. After they confirmed with the girl that she did not know the man, Guo and his friends tried to stop him. They got into a fight, during which the girl ran away. Guo called an ambulance for the man after he fainted.
    At the hospital, the man was declared to have several significant injuries and level VII disability as a result of the fight. On August 4, 2015, Guo was accused of intentionally injuring the man.
    Guo has always been a top student at school. However, because of the incident, he did not even get to take the national college entrance exam. And because of the charges against him, no company wants to hire him. On April 18, Guo was sentenced to two years and six months in prison with three years’ probation. He was fined 157,173.76 yuan.
    Now Guo’s former classmates and teachers are trying to help him to find the victim so she can testify on Guo’s behalf.

    The shocking scenes were caught on camera as people used bars and poles to attack each other

    This was the moment a children's kung fu competition ended in a mass brawl as adults piled into the ring.

    The brutal scenes took place at the European Championship in Kung Fu being held in the Ukrainian city of Lviv.

    As the footage shows, the brawl started when two youngsters in the ring from Armenia and Azerbaijan refused to stop battling it out despite the bell being sounded.

    It was a semi-final match and 12-year-old Armenian David Petrosyan was about to win, when support staff from the Azeri athlete ran into the ring and joined in.

    Then about around 50 men started fighting, using bars and poles to attack each other.

    Even the President of the Kung Fu Federation of Europe, Nikolai Matulevskiy, ended up being hit, apparently by a member of the Azerbaijan team when he was trying to hide the Armenian athlete Nikolai Matulevskiy behind him.

    The fight escalated quickly, moving from the fighting ring to rest of the gym, with some of the people using sticks and poles to fight each other.

    The fight was eventually stopped by security guards.

    The team from Azerbaijan has been disqualified for inappropriate behaviour at the competition.

    An Orlando karate teacher sent an 11-year-old boy in her class nude pictures and told him she wanted to have sex with him, police said Monday.

    Stephannie Figueroa, 21, faces charges of attempted lewd or lascivious conduct, solicitation and contributing to the delinquency of a minor, showing a minor obscene material and child abuse, according to the Orlando Police Department.

    The boy’s mother opened the his Kik social messaging app on his phone last week and found Figueroa’s sick messages to him, according to a police report cited by the Orlando Sentinel.

    N.J. substitute teacher admits to sexual activity with students
    “I want to have sex with you,” she told him in one message inviting him to her 21st birthday party, investigators said.

    “OK IDC," the boy replied, using a shorthand for “I don’t care.”

    Figueroa told the boy nobody else would be home during the party, according to police. She began making advances on him in February and kept telling him that she liked him, the boy told police. Investigators believe she sent him 15 nude or racy photos.

    It's still creepy, Gene. I don't care if it's every pubescent and pre-pubescent boy's fantasy to get it on with his teacher, or if the boy is physically big or tall for his age. Even though she's quite young at 21, the difference in the mental/emotional development between a 21 year old woman and an 11 year old boy is tremendous (among normal people, that is).

    A Kakamega man left a packed court in stitches after claiming that a Chinese construction boss attacked a worker’s union leader using tactics only seen in Kung Fu movies.

    Paul Omondi told the Kakamega Senior Resident Magistrate’s court that Lu Ti Ti deftly employed kicks and blows against Caleb Jumba and himself. Omondi, a tyre puncture repairer at Covec, a Chinese road construction company, was testifying as a witness in a case in which Lu Ti Ti and Caleb Jumba, a workers’ union leader, have been charged with fighting in public on April 13, 2016.

    Omondi said trouble started when Jumba visited their work station at Iguhu along the Kisumu-Kakamega road in a routine meet-the-workers tour at about 11.30am.

    “Lu Ti Ti and Jumba engaged in a quiet conversation, and when all seemed well, Lu Ti Ti grabbed the mzee’s collar and roughed him up. The mzee panicked, lost balance and fell on the ground. Lu Ti Ti then started stepping on the old man’s chest. It is then that I jumped in to rescue mzee who was panting heavily,” Omondi told the court.

    He went on; “Before I knew it, the Chinese man turned on me with kicks and blows. He then hit me with a piece of wood. Fellow workers had to carry mzee out of danger.”

    During cross examination, Lu Ti Ti’s lawyer took Omondi to task on how a human being can kick, throw a blow and use timber at the same time.

    “I think Chinese are born fighters. They do it so unbelievably,” said Omondi eliciting laughter in the court.

    Questioned by Jumba’s lawyer, as to whether there was actually a fight between the two, he responded that, “Hakukuwa na vita, ilikuwa ni mzee Jumba kuchapwa (there was no fight between the two, it was the old man being beaten)!”

    He said he had no ill feelings against Lu Ti Ti, besides that small matter of Covec settling an outstanding Sh5,000 wage balance.

    Lu Ti Ti was arrested at Kisumu International Airport allegedly on the run after a warrant of arrest was issued against him.

    “We have information that Lu Ti Ti was boarding a flight from Kisumu to Nairobi then to Tanzania where there is a branch of Covec,” explained Ondieki to the court.

    The accused are out on a Sh70,000 bond each, with Lu Ti Ti’s passport having been deposited with the court. Caleb was also asked to have a Kenyan surety.

    Their case will be heard on August 9.

    Video has emerged of Bastille Day killer Mohamed Lahouaiej Bouhlel injuring an opponent by using banned moves during a martial arts contest.
    The clip, filmed in a sports hall in 2010, shows the truck terrorist wearing a red belt as he struggles with another fighter on a mat.
    The pair can be seen kicking out at each other as well as tussling as they both brawl on the floor.
    After the fourth whistle is blown, Bouhlel appears to punch his opponent in the stomach. The man falls to his knees in agony and the game is temporarily suspended.
    The footage was filmed six years before the French-Tunisian decided to drive a 19-tonne lorry through crowds on a promenade in Nice on Bastille Day, killing 84 people.

    His opponent, who asked not to be named, said he remembers Bouhlel as a novice who repeatedly made mistakes during the fight, saying he would strike with his head and elbows which are banned by the rules.
    The video comes after pictures of Bouhlel posing for a selfie in the truck he used to massacre 84 people emerged.
    Taken just hours before he ploughed into crowds on Nice's Promenade des Anglais, the smirking killer looked relaxed as he prepares to commit mass murder.
    In the first picture, taken on July 12, two days before the massacre, he sits in the cab of the rented 19-tonne truck next to a friend and sticks his middle finger up.
    The second picture showing him grinning next to a friend wearing a Paris St Germain shirt of them stood next to the lorry was taken on July 13, just 24 hours before the horror which killed 10 children.
    Gym-loving Bouhlel, a father of three, who used dating sites and had a 73-year-old gay lover, is said to have sent the pictures to friends and family back home in Tunisia before the attack.
    It is unknown if the friend he is pictured with is an accomplice and whether the man next to him in the pictures has been questioned by detectives.

    French anti-terror police retrieved the photos from his mobile phone after he was shot dead in the carnage.
    ‘The photos are part of a body of mobile phone evidence,’ said a source close to the case. ‘His device is loaded with pictures like this.’
    Bouhlel was wearing a black-and-white checked shirt, and had a friend sitting next to him, when he took the photo on July 12th – last Tuesday.

    This has been pinpointed by as the day Bouhlel started staking out the Promenade des Anglais in the hired lorry.
    He drove up and down the famous beachside strip where – on July 14th, Bastille Day – he would strike during a holiday fireworks display.
    The second picture, taken on the eve of the attack, shows Bouhlel grinning broadly as he and a friend stand by the lorry.
    The front of the lorry looks very different to the bullet-holed wreck which was riddled with gunfire and had its panels smashed off during its horror drive along the promenade.
