    Martial arts fighter indicted, faces up to 23 years for officer assault

    DAYTON - A 27-year-old mixed martial arts pro authorities say started a wild brawl with police outside a bar faces up to 23 years in prison and a fine of $34,000 according to Montgomery County Prosecutor Mat Heck, following a a seven-count indictment from a Montgomery County grand jury.

    The indictment includes charges of felonious assault and resisting arrest related to the fight that ended up injuring six: three Dayton police officers, an off-duty West Carrollton officer and two civilians who helped bring the fighter into custody.

    The first-degree felonious assault charge carries a specification of repeat violent offender and a mandatory minimum sentence of 10 years.

    Nikolaos R. Boscarino, who has a history of violent assaults, turned himself in Tuesday afternoon. Heck said he has asked the court to hold him on a $250,000 bond.

    Boscarino is a former Bellbrook High School wrestling champion. In October 2002 he was sentenced to prison for beating a young man in what authorities called “a gang fight” along a county road in northern Warren County. He was released after serving 20 months of a four-year sentence.

    Police gave this account of the August fight: It began after police officer Donnie Smith, who was in uniform, arrived at Taggart’s Pub at the intersection of Patterson Road and Wilmington Pike around 2 a.m. Three men exited a late-model white Cadillac and walked toward the bar. The bar owner, seeing the men as too drunk to be admitted, told officer Smith he did not want the trio on his property.

    Boscarino then stopped, undid his fly and urinated in plain view on the middle of the sidewalk, exposed to the vehicle traffic on Patterson and Wilmington.

    When Smith approached to perhaps write a ticket for the rude display, Boscarino immediately punched him in the face with his fist and started to walk away.

    The officer then tried to restrain him and radioed for backup. He hit Boscarino with a Taser shot, but it was ineffective. It took the efforts of the six to get Boscarino under some control, enough to wrest him into handcuffs.

    Officer Smith, who suffered a concussion, remains off-duty, Heck said. He said medical confidentiality law prohibits him from disclosing further details. He added, however, that it is not known when Smith, an 11-year veteran, will return to work. Two other Dayton officers, John Howard and John Kernich, were also injured, but are back on the job.

    As a mixed martial arts fighter, Boscarino has a 3-and-13 record as a professional. He is undefeated as an amateur.

    “This defendant thinks he can do whatever he wants,” Heck said at a news conference to announce the indictment. “He’s shown an utter disregard for authorities and police officers. The defendant is a trained pro fighter and can fight past the pain.”

    Maybe he should have fought drunk during his pro fights, he might have been 13 and 3 instead of the other way around. Injuring 3 cops and 3 others while being tased is pretty impressive.

    Apple Valley heavyweight Brett "The Grim" Rogers could get five years for an attack that made his spouse black out.

    Brett "The Grim" Rogers, a heavyweight mixed martial arts fighter, has admitted that he beat his wife in Apple Valley, knocking her out.

    Rogers, 30, pleaded guilty to third-degree assault, a felony, in Dakota County District Court on Thursday and faces up to five years in prison.

    Neighbors called police June 29 after hearing a woman's screams and glass breaking. One reported seeing Rogers standing over his wife, punching her repeatedly in the head and face as she lay on a back lawn, a complaint says.

    Police found her walking near a school. At first, she was reluctant to tell them what happened, court papers say.

    In an ambulance, the spouse, identified only as T.R. in the complaint, told an officer and paramedics that she and Rogers were arguing when he choked her. She ran to the back yard, where he caught up with her and began hitting her head and face, causing her to black out. She suffered a golf-ball-size lump above her left brow, more bumps on her forehead, injuries to her jaw and ear and a knocked-out tooth.

    Later, she refused to meet with police and told them the assault was her fault, the complaint says.

    Three counts of domestic abuse by strangulation, pattern-of-stalking conduct and child endangerment were dropped in the plea arrangement. Rogers is to be sentenced Nov. 30.

    Mixed Marital Arts heavyweight fighter Brett Charles Rogers was arrested again Monday morning in Apple Valley after authorities say he violated terms of his pre-sentencing release.

    Brett Charles Rogers, the mixed martial arts heavyweight fighter from Apple Valley who pleaded guilty last month to assaulting his wife in June, was arrested this morning on an outstanding warrant.

    Rogers, 30, pleaded guilty in September to felony third-degree assault after a late June incident in which Rogers’ wife suffered injuries to her face, ear, neck and back and lost a tooth.

    A warrant for Rogers’ arrest was issued Sept. 30 after he failed to comply with conditions of his pre-sentence release. He turned himself in to police at 6 a.m. Monday.

    He was scheduled to make a first appearance following his latest arrest Monday morning in Dakota County District Court in Hastings.

    It was the third warrant issued for Rogers since he was initially arrested in June. The first warrant, issued in mid-September, was revoked after it turned out to be the result of scheduling confusion among court officials; a second warrant was issued several weeks later after authorities said Rogers violated a protection order against his wife.

    Rogers’ wife told authorities in June that the assault was her fault and reportedly refused to testify against him. She told police that she didn’t want him charged with assault, because she didn’t want to “cause him trouble” with his job, according to the criminal complaint.

    After he was charged, Rogers’ contract with Strikeforce—a mixed martial arts and kickboxing organization that televises events and competitions on CBS and Showtime—was terminated. However, it was announced in early September that Rogers was set to return to the sport, and he told 5thRound.com he was “confident” that the charges would be dropped.

    Rogers—who weighs 258 pounds and was ranked among the top 10 Mixed Martial Arts heavyweights in the country—lost to Eddie Sanchez on Sept. 23 in his fighting comeback in the Titan Fighting Championship.

    As part of the plea agreement with prosecutors to which Rogers agreed last month, charges of domestic assault by strangulation, harassment and endangering a child will be dropped when Rogers is sentenced.

    Rogers’ sentencing is scheduled for Nov. 30. He faces a maximum penalty on the assault conviction of five years in prison and a $10,000 fine.

    I just flashed on this idea for a new reality TV show where all the busted MMA fighters are forced to live together and do community service. I'd be more into that than Ultimate Fighter.

    Now I'm wondering if MMA fighters get street cred for jail time, just like rappers. I hope not. That's such a horrid role model for public figures.

    A heavyweight mixed martial artist was sentenced today to 60 days in jail for beating his wife in June at their Apple Valley home in front of their children and a neighbor.

    Brett "Da Grim" Rogers, 30, of Apple Valley, pleaded guilty to felony third-degree assault in Dakota County District Court. Two felonies of domestic assault by strangulation and stalking were dismissed, as well as a gross misdemeanor charge of endangering a child.

    This morning, District Judge Karen Asphaug also ordered Rogers to three years probation with several conditions, including having no contact with his wife until he completes a domestic abuse program and his probation officer approves the contact. Rogers also cannot use alcohol and drugs.

    Rogers received credit for 26 days served in jail. He'll serve at least two-thirds of the jail sentence, which means he has about 14 days remaining, Asphaug said.

    Rogers plans to participate in a fight Dec. 31, his attorney Murad Mohammad said in court. Asphaug said Rogers can travel for work. However, she said he cannot postpone his jail sentence until after the fight - as requested by his defense - to train for the event.

    The assault happened June 28. A neighbor told police he saw Rogers punching his wife as she lay on the ground outside their house after she fled from Rogers, a criminal complaint stated.

    Police later found the woman walking by a nearby school. Her face was bloodied, and she was missing a tooth and had a "golf ball-size lump" above her left eyebrow, among other injuries, the complaint said. She told police her husband became angry during their argument and attacked her, causing her to black out. The woman sustained a broken jaw from the attack.

    The couple's children, who went to a neighbor's after the incident, said that they were afraid to go home and that their father had choked them before, the complaint said.

    Rogers is a 6-foot-4, 270-pound heavyweight fighter who competed for Strikeforce, a mixed martial arts and kickboxing organization based in San Jose, Calif.

    Not that I know a great deal about it, but my impression is that you don't get much street cred for prison *IF* you are in for beating up women or raping kids. Even most hard-core criminals have no respect for those deeds.

    Mixed Martial Arts Fighter Taken to Court

    DALLAS (CN) - Dutch mixed martial artist and kickboxer Alistair Overeem will have to wait to collect his $385,000 fight purse from last Friday's Ultimate Fighting Championship pay-per-view contest in Las Vegas.
    Overeem's former fight team claims the fighter stiffed them for the 30 percent he owes in commissions under their management contractand that he walked away from the deal after they negotiated a new contract with the UFC on his behalf.
    Netherlands-based Team Golden Glory fight team sued Overeem and his representative Collin Lam on Thursday in Clark County District Court, Las Vegas.
    On Friday, the court issued a prejudgment garnishment order, so the Nevada State Athletic Commission withheld his check from the Friday fight.
    Golden Glory claimed that Overeem failed to pay its cut after he defeated Brazilian fighter Fabricio Werdum in Dallas on June 18. The team says Overeem received a combined bout fee and win bonus of $170,000, and $50,000 in sponsorship money. That event was put on by Strikeforce.
    Zuffa LLC, which owns the Ultimate Fighting Championship, had purchased Strikeforce in March. Several weeks after Overeem's victory, he was released by Zuffa with one fight remaining on his contract with Strikeforce. Several other Golden Glory-managed fighters were released as well.
    At the time, UFC president Dana White told MMAFighting.com that "it's tough to do business with [Golden Glory] ... The way they do business is, you have to pay them, not the fighters. We don't work that way. It's not the way we do business. It's not how it works in the United States with the athletic commissions. You don't pay the managers and the managers pay the fighters. You pay the fighters and the fighters pay the managers."
    ESPN reported that Zuffa retained the exclusive negotiating right with Overeem after his release, so Golden Glory negotiated on his behalf and he signed a new contract with the UFC on Sept. 6. Two months later, Overeem's representatives demanded money owed from Golden Glory, ultimately resulting in Overeem suing the team for $151,000 and asking for an order to break the contract, which runs through July 2012.
    When asked why he left Golden Glory after 11 years, Overeem said it was for a "breach of trust," that he was taken advantage of, according to ESPN.com.
    In its lawsuit, the fight team says that "subsequent to the execution of the UFC contracts, Overeem made numerous public statements that [Golden Glory] breached its fiduciary to him and that there was 'mistrust.' Overeem claimed that Zuffa's CEO, Lorenzo Fertitta told him in no uncertain terms that: there is a one million dollar 'signing bonus;' that the one million dollar signing bonus was Overeem's money and that KOI/GG was 'ripping him off' and 'stealing from him.'"
    A bond of $200,000 is required to execute the garnishment order. It is not known if a bond had been posted before the court closed for the New Year holiday.
    UFC chief legal counsel Laurence Epstein told MMAjunkie.com on Friday, "whatever valid order is in effect, we will certainly comply with."
    Roderick Lindblom, attorney for Golden Glory, told ESPN.com, "The suit was filed for a very simple reason. Alistair Overeem has been part of Golden Glory for 11 years. Knockout Investment has a management contract with him. The management agreement was from 2007 until 2012. They negotiated one of the largest MMA agreements in the history of the sport for him. And within days he accused them of some pretty shady stuff that is not true. And he has walked away from his contract."
    On Friday, Overeem defeated former UFC Heavyweight Champion and former professional wrestler Brock Lesnar via technical knockout in the first round due to kicks to the body and punches to the head.
    Overeem now is scheduled to challenge for the heavyweight title this year against reigning champion Junior Dos Santos of Brazil.
    MMAJunkie.com reported that Overeem was to have been paid $385,714.28 for the fight, which includes a $121,428.57 win bonus, while Lesnar was paid $400,000. The disclosed pay does not include "locker room" or special bonuses, sponsor pay or portions of pay-per-view revenues that are paid to certain top fighters.

    Former UFC fighter Hermes Franca sentenced to 42 months in prison for sexual abuse of underaged student

    A former Ultimate Fighting Championship lightweight title contender has been sentenced to more than three years in prison after being convicted this week of sexually abusing an underage female student at his Clackamas martial arts school.

    Hermes Franca Barros, 37, pleaded guilty in Clackamas County Court on Wednesday to one count of unlawful penetration and one count of first-degree sexual abuse. He was sentenced to 3½ years in prison.

    He was arraigned in May on seven counts of first-degree sexual abuse and two counts of second-degree unlawful sexual penetration. The remaining counts were dismissed.

    Barros will also have four and a half years of post-prison supervision and must register as a sex offender.

    Barros, a resident of Jupiter, Fla., turned himself in to Clackamas County Sheriff's Deputies in May after a warrant was issued for his arrest, stemming from a December 2010 encounter with one of his students.

    Barros operated the Team Hermes Franca Brazilian Jiu-Jutsu Academy. He has a 22-12 record as a professional mixed martial artist and fought for the UFC off and on between 2003 and 2009.

    He unsuccessfully challenged for the promotion's lightweight title in 2007. After the bout he was suspended from competition for a year and fined $2,500 by the California State Athletic Commission for testing positive for a banned steroid in his post-fight drug test. He last fought in April, losing by knockout in the second round during a fight in Brazil.

    Last June, Barros apparently left a message to his fans on an MMA online forum reflecting that he immigrated from Brazil to the U.S. in 2000 with $300 and speaking very little English but eventually "lost sight of what is truly important (in) life."

    Martial arts champion released on bail after Moscow killing

    The charges against Rasul Mirzayev, the world champion in mixed martial arts who killed a student in Moscow last summer, have been reduced, a lawyer for the student’s family told the RAPSI news agency.

    Mirzayev, 25, from Russia’s North Caucasus republic of Dagestan, is accused of killing Ivan Agafonov, 19, on August 13, 2011 after arguing over a young woman outside a nightclub in downtown Moscow.

    “Today investigators charged Mirzayev with Article 109 of Russia’s Criminal Code - ‘infliction of death by negligence’ - which is milder than Article 111 - ‘intentional infliction of a grave injury leading to death,’” attorney Oxana Mikhalkina said.

    The Investigative Committee confirmed that the charges had been reduced.

    Mikhalkina also said the champion faces no more than two years in prison compared with up to 15 years under the previous charge.

    Agafonov’s friends said that the argument started with an innocent prank - Agafonov was playing with a toy car, walked up to Mirzayev’s girlfriend, Alla, and offered her a ride as a joke. But Mirzayev decided Agafonov had insulted her.

    The world champion hit Agafonov in the face, and the young man fell down and struck his head against a metal drain cover. He was taken to hospital and died without regaining consciousness a few days later.

    Moscow’s Presnensky Court in mid-December extended pre-trial custody for Mirzayev until February 17.

    Top UFC heavyweight contender Alistair Overeem has been charged with misdemeanor battery.

    The former Strikeforce heavyweight champion faces up to six months in jail if convicted, plus a fine of up to $1,000.

    According to Las Vegas police, Overeem allegedly shoved a woman in the face at about 3 a.m. local time Jan. 2 at a Las Vegas Strip casino. The shove from Overeem, who is 6-foot-5 and weighs in excess of 260 pounds, caused the woman to stagger backward.

    Overeem, 31, is scheduled to appear Feb. 21 in court.

    "Alistair was not arrested, but was summoned to court," Las Vegas-based defense attorney David Chesnoff said in the Las Vegas Review-Journal. "There are two sides to this story and we intend on vigorously defending this.

    "Alistair maintains his innocence."

    The charge was first reported by the Review-Journal.

    The alleged incident occurred just a few days after Overeem defeated former heavyweight champion Brock Lesnar during a title eliminator at UFC 141 in Las Vegas. Lesnar retired from mixed martial arts competition immediately after the Dec. 30 first-round TKO loss.

    Overeem (36-11, 1 no contest) is slated to face current UFC heavyweight titleholder Junior dos Santos. A date for that fight has yet to be announced.

    The misdemeanor battery charge isn't the only legal matter confronting Overeem.

    Hours before facing Lesnar, Overeem was hit with a civil lawsuit by his former management team, Knock Out Investments, also known as Golden Glory.

    The suit alleges that Overeem failed to pay a 30 percent commission to Knock Out Investments following his June 18 victory over Fabricio Werdum during a Strikeforce bout in Dallas.
    Gotta love the timing of that lawsuit.
