3. The Waiver This one is a little tricky. There currently are copies with Rudy's 'promoter' and copies at the venue, correct? Anthony has agreed that he does not need to be sent a copy, but will sign the waiver at the venue when he arrives on Oct 1st for the fight, correct?


I think both Rudy and Anthony need to confirm if this is correct; and if it is incorrect in any way, correct it. We need to make sure ALL PARTIES are on the same page. The date is drawing near, there is just a little over 3 weeks to go.

If you are indeed serious about doing this match, you should get and read the waiver beforehand. The chances are there may be a clause or two that is very disadvantageous to you. You don't want to find out the day of the fight that it is your responsibility to pay for medical costs, missed work, and pain and suffering damages for your opponent if he is injured.

Paperwork should always be finalized at least a week or two before any kind of match happens.

Getting the waiver beforehand is important and you were stating that you were going to ensure that would happen. That would mean that any unreasonable stipulations could have been taken out in advance.

Waiting until the last minute to get paperwork done and then submitting paperwork that is unacceptble when it is too late to change is a classic negotiating gambit to make it look like the opposing side will not cut a deal.

Ok, my .02 cents just because I find all this somewhat amusing.

1. CMA fighters train regularly and train to handle street attacks at any time, any where.

2. Sport fighters seem to like to have time to train for a fight (don't read too much into this statement) but I've seen them take a fight on very short notice, plus they train regularly as well, so I'm guessing they're able to fight any time, any where.

3. It's EXTREMELY lame, IMO, for a fighter (I mean a real fighter) to threaten legal action against a challenger, unless attacked after declining or being stalked or harassed.

4. I understand the liability issues involved with running a school but a FIGHT school not allowing a FIGHT (challenge) to take place is also EXTREMELY lame (again just my opinion).

With that said I don't see why either one can't just show up at the training location of the other, or take it outside to a nearby parking lot or alley, and just throw down a challenge. Apparently there are times when they're within easy driving distance.

Waivers, neutral venue and time to get into tip top shape is great if you get it but bottom line is fighters fight, just get to it and pay your own medical bills (don't fight if you can't afford injury) and don't cry to the cops or lawyers (don't fight if you can't afford to lose).

What's so hard about that?

Don't MMA schools have open mat days and allow outsiders in to fight? At last there would be some protection against excessive injury and even impartial judges.

On a side note anyone know the legal repercussions of trying to sue someone for injuries from a fight that was mutually agreed to before hand? Other than charges of illegal fighting.

so, it looks like it's October 1st, 7 PM at Action Fitness, both parties have apparantly agreed that they will be there; so it seems that the only sticking point is the waiver, which, as far as I can tell, both parties do want to have

it seems that the trouble is that Anthony is unable to receive / go get it, for some reason: why can't the person writing it fax it to him? baring that, why can't it just be mailed? baring that, is Anthony that far away from where it is ostensibly located? or is it that Anthony and the person writing it can't sem to get in contact with each other (which is strange - can't that information be transmitted in some way?)

I'm also confused why there is no "electronic" version of the waiver available - unless the person who wrote it is the only one in the 21st century not using a computer to write things, I can't imagine why that is the case

What else was there to do? Got the takedown, kept dominant position until the guy gave up. In a BJJ match, I could've sat in the headlock, from guard for that matter, all day and still won.

Osiris, just give up. Anyone saying JFS was not totally humiliated/owned is a lost cause. They make those Holocaust deniers look rational. All that evidence right in their faces and still not a clue. It's beyond sad.

Since the waiver seems to be the major potential sticking point, below is one I had drawn up and have been using for years with no problems. Feel free to use it.

Also, you guys should have written up and agreed upon the rules (how is the contest to start and end, time limits, techniques not allowed) and other miscellaneous concerns (number of cornermen, reffing, number of observers from each side allowed, number of video cameras allowed, etc.)?

It is best to allow at least one video camera for each side (keeps videos from being doctored up), to have each opponent stand in separate corners and be started by a third party, and for each fighter to have a cornerman who is responsible for throwing in a towel to signal the end of the match if his fighter is KO’ed, taps, or cannot continue (this cuts down on arguments afterwards on whether or not a fighter tapped or was unable to continue since the final determination came from his own corner rather than a referee).

I understand that I will be entering into a martial arts competition against a martial artist/fighter who has extensive experience. I understand that this match will include a variety of martial arts techniques that may include some or more of the following: joint locks, body throws and slams, chokes, strikes to the head, face, throat, limbs, body, and groin, kicks, elbow and knee strikes, eye gouges, and bites.


General Description of Potential Risks
I understand that I may receive a variety of injuries to my head, face, limbs and body as a result of this martial arts match. I know there is a risk of certain abnormal changes occurring during or following this type of competition which may include abnormalities of blood pressure or heart rate, ineffective functioning of the heart, feelings of dizziness or nausea, and in rare instance, heart attacks or strokes. I also understand that engaging in this activity can potentially lead to musculoskeletal strains, pain, injury, bleeding wounds, eye damage, broken bones, dislocated joints, unconsciousness and, possibly, death.

I am stating that I am an experienced martial artist and understand the risks of entering into this type of competition. I am entering into this event under my own volition.


WAIVER & RELEASE OF LIABILITY

I, the undersigned, do voluntarily release, discharge, waive and relinquish any and all causes of action for personal injury, property damage or wrongful death which may result as a result of engaging in this martial arts challenge match.

It is my intention by signing this document, to exempt (insert fighters, managers, facility and other interested parties here) and their agents, servants, instructors, and employees from liability for personal injury, property damage or wrongful death caused by the negligent act or omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with my participation in this activity. By signing this document, I acknowledge that I assume the risk of personal injury, property damage or wrongful death upon myself.

I hereby agree to expressly assume and accept any and all risks of injury or death arising from my participation in this activity.

I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation in this activity. I acknowledge that I have either had a physical examination and been given my physician's permission to participate in this activity, or that I have decided to participate in this activity without the approval of my physician and do hereby assume all responsibility for my participation in these activities.

I, the undersigned, acknowledge that I have read the foregoing paragraphs and fully understand the legal rights that I am giving up by signing this document. Any questions which may have occurred to me have been answered to my satisfaction.
